We have seen an increase in cargo claims related to improper securement.
Improper cargo securement poses a serious risk to drivers and other motorists by adversely affecting the vehicle’s stability. Unsecure cargo can shift or fall, which could result in traffic hazards, vehicle collisions, injury, or death.
Per Title 49 of the Code of Federal Regulations under section 171, motor carriers are responsible for ensuring cargo is secured such that it will withstand the ‘rigors of transport,’ which include but are not limited to:
• Changes in temperature
• Changes in pressure
• Changes in humidity
• Shocks and forces that occur in transit
• Vibrations from suspension
• Road surface (asphalt, gravel)
• Road conditions (construction, weather, debris)
• Wind shear
• Braking
• Acceleration
When drivers are being loaded, they can help ensure cargo is properly secured by checking that tie downs or other securing devices were utilized correctly.
